Privacy Policy

1. Introduction

Piku Africa Limited (hereafter referred to as "company", "we," "us," or "our") recognizes the importance of your privacy and is committed to protecting your personal data. This Privacy Policy outlines how we collect, use, and share information about you when you use our website and mobile app (collectively referred to as "our digital assets"). By accessing our digital assets, you agree to the terms of this Privacy Policy.

The Personal Information Protection Act of 2022 ('PIPA' https://www.pdpc.go.tz/media/media/THE_PERSONAL_DATA_PROTECTION_ACT.pdf) sets out the rules and principles governing the collection, use, disclosure and care for your Personal Information by a Collector or Processor. It recognizes a person's right (data subject rights) to protect their Personal Information by mandating a Collector or Processor to process (collect, use, disclose, erase, etc) such Personal Information in accordance with the individual's rights.

In compliance with the PIPA, Piku Africa Limited ("the Company") wishes to inform its users of the way it processes their Personal Information in this Privacy Policy.

2. Acceptance of This Policy

This policy applies to any data we collect in relation to your use of our digital assets site and/or app. You accept the terms of this Privacy Policy upon your first use of our digital assets. If you do not agree with our policies and practices, do not use our digital assets.

The definitions to key terms for the purpose of this Policy can be found below.

Definitions

"Collector" - means a person, individual institution or public institution that alone or together with other institutions determines the purposes and methods of personal information processing; and where the purposes and methods of processing are specified in the law, the "Collector" is a person, entity or public institution appointed in accordance with the law and will include its representative.

"Recipient" - means a person, entity, public institution or any other person who receives Personal Information from the Collector.

"Processor" - means a person, entity or public institution that processes Personal information for and on behalf of the Collector under the instructions of the Collector, except for persons who, under the direct authority of the Collector, are permitted to process Personal Information, and will include their representative.

"Data Subject" means the subject of Personal Information.

"Personal Information" - means information about an identifiable person that is maintained in any form, including- (a) personal information relating to an individual's race, national or ethnic origin, religion, age or marital status; (b) personal information relating to an individual's education, medical history, criminal history, employment or financial transactions; (c) any identification number, mark or other special form that identifies an individual; (d) the person's address, fingerprints or blood type; (e) the name of an individual that appears in the personal information of another person related to him or where the disclosure of that name will reveal the personal information of the person; (f) information sent to the collector of personal information by a person, which it is clear that the information is personal or confidential, and responses to the information may reveal the content of the previous information, and the view or opinion of any other person about the subject of the information.

"Processing" - means the analysis of personal information, by automated means or otherwise, such as collecting, recording or holding personal information or performing analysis on personal information, including- (a) reorganizing, retrieving and using it as is or change them; (b) return or use them; or (c) align them, combine them, prevent their use, delete or destroy them.

"Services" - The goods and services, which includes the access to Piku App, platforms, and websites, promoted, offered, or provided by the Company.

"Account" - An account required for accessing specific features and services on our site.

"Cookie" - A small text file placed on your device by our site to enhance user experience.

"Our Digital Assets" - Refers to the website www.piku.africa, the mobile application, and Platform.

"Applicable Laws" - Includes the Constitution of Tanzania, the Cyber Crimes Act, and any relevant data protection regulations.

3. Ownership

Our Digital Assets are owned and operated by Piku Africa Limited with registration number - "169933448", located at No. 2 Old Bagamoyo Rd. Mbezi Beach, Dar es Salaam, Tanzania, www.piku.africa. Access to our digital assets is restricted to individuals located in Tanzania and other African Judications where we have registered operations.

4. Collector

The Collector is Piku Africa Limited, with registered office in No. 2 Old Bagamoyo Rd. Mbezi Beach, Dar es Salaam, Tanzania, who is the license holder for services offered through its own brands (hereinafter referred to as Piku).

5. Scope of This Policy

This Privacy Policy only applies to our digital assets. It does not cover third-party websites linked from us. We recommend reviewing the privacy policies of any third-party sites you visit.

6. Information We Collect

We collect various types of data, including:

  • Personal Information: Name, date of birth, gender, job title, profession, contact details (email address, phone number).
  • Financial Information: Payment details such as credit/debit card numbers.
  • Automatically Collected Data: IP address, browser type, operating system, referring website URLs, and user activity on our site.
  • Demographic Information: Preferences, interests, and geographical location.

You will be asked to create a unique username and password combination for your account, in addition to the above. This information enable easy access to our digital assets. Once a registered customer, additional information is processed on an on-going basis to ensure that our Services are offered to you in the best possible manner. You must use your unique logins to access your account.

When you are logged into your account, we may collect:

  • a record of all your visits to our digital assets;
  • basic technical information relating to the device, such as the device identifier, and browser you use to access our digital assets;
  • details of transactions you carry out through our digital assets, such as payments, product selection, preference, and purchase and bids;
  • communications with us or our employees which includes calls, emails, and messages sent through the our customer service channels;

In certain instances, we may also request that you send us additional information to verify your identity. This may include:

  • copies of photographic identification documents, especially upon winning or delivery of goods;
  • proof of address; and
  • source of funds for your account.

Your documents are always stored and treated in a secure manner.

In some limited instances, we may conduct open-source checks which involves the access of public records and publicly available information about you including news articles, social media accounts, forums posts and official records.

To ensure your safety and that of the Company, we use services provided by third parties to help us decide whether to accept transactions from you by assessing your method of payment and the devices you use to visit our websites. These third-party services check whether the device or method of payment has been utilized for fraudulent or abusive transactions in the past such as reported instances of identity theft, promotion abuse, or credit card fraud.

7. How We Use Your Data

We may use your data for the following purposes:

  • Account Management: To create and manage your account on our site.
  • Service Provision: To provide and maintain our products and services, including personalized content and features.
  • Communication: To send you updates, newsletters, and promotional materials, provided you have opted to receive them.
  • Customer Support: To respond to your inquiries and provide customer support.
  • Market Research and Analysis: To understand usage patterns to improve our services and user experience.
  • Compliance: To meet legal obligations and protect against fraud, money laundering, and other risks.

In compliance with regulatory obligations, we may be required to disclose your information to government authorities, such as the police or regulators. Personal Information may also be shared with regulators, agencies, or relevant bodies in instances where we become suspicious that an account holder may be involved in match-fixing or the breach of gaming regulations. We will also disclose information as required to enforce our terms of use as stated in our Terms and Conditions.

8. Legal Basis for Processing Your Data

We ensure that your personal data is processed lawfully and fairly. We process your data based on the following legal grounds:

  • Your consent.
  • Performance of a contract (e.g., providing account-related services).
  • Legal compliance.
  • Protection of vital interests.
  • Legitimate interests pursued by us as long as they do not override your rights.

We take great care in implementing and maintaining the security of the Services and your information. We have put in place appropriate physical and technological safeguards to help prevent unauthorised access, to maintain data security, and to appropriately use the information we collect online. These safeguards vary based on the sensitivity of the information that we collect and store.

We employ industry standard procedures and controls to ensure the safety of our users' information, such as:

  • securing network topology, which includes intrusion prevention and firewall systems;
  • encrypted communication;
  • authentication and access Control; and
  • external and internal audit tests.

Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse the Services. We make no warranty, express, implied or otherwise, that we will prevent such access.

9. Data Retention

We will retain your personal data only for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, or accounting requirements.

Except as otherwise permitted or required by applicable law or regulatory requirements, we endeavour to retain your Personal Information only for as long as we believe is necessary to fulfil the purposes for which the Personal Information was collected (including but not limited to for the purpose of meeting any legal, accounting or other reporting requirements or obligations). We may, instead of destroying or erasing your Personal Information, make it anonymous such that it cannot be associated with or traced back to you.

10. Data Protection and Security

We take data security seriously. We employ a variety of security measures to protect your data against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encryption of sensitive information.
  • Regular security audits and vulnerability assessments.
  • Restricted access to personal information.

11. Sharing Your Data & Transfers

  • Affiliates: Other companies within our corporate group.

The information we collect from you may be transferred to, and stored at, a destination outside of Tanzania. It may also be processed by staff operating outside Tanzania who work for the Company or for one of our suppliers. Such staff may be engaged in, among other things, the fulfilment of your request, the processing of your payment details, the provision of support services, or any other activity related to servicing any of your requests that you might place with us from over the course of your time with us.

We will take all reasonably necessary steps to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy by making sure such data transfers comply with applicable laws. Once we have received your information, we will use strict procedures and security measures to prevent unauthorized access and ensure the integrity and availability of your Personal Information.

We are required to keep full records of all financial and bid transactions together with any identification provided. We will hold your Personal Information on our systems for as long as is necessary under our legal obligations.

12. Cookies and Tracking Technologies

Cookies are text files containing a small amount of information that are downloaded to your device when you visit a website. Most websites utilise cookies to improve your digital experience and to ensure that content and functions are delivered and used more effectively.

We use cookies and similar tracking technologies to enhance your experience on our site. Cookies help us:

You agree that the Collector may, from time to time, place cookies on your device to save information (such as your username, password, personal details, e-mail address, and technical device information such as the model and its IP address) to make full use of the functionality and Services on our digital assets and to allow your browser and app to identify you as a user. This ensures that you do not have to re-enter your information each time you visit our websites. These cookies cannot be used to run programs or deliver viruses to your computer and are uniquely assigned to you. Additionally, these cookies can only be read by the web server(s) that placed the cookies on your device.

At any time, you can amend your browser settings to block some or all cookies from the Collector. However, if you block cookies from the Collector, some or all the of functionality of our digital assets may not perform as intended. For example, you may not actually be able to place any bets.

13. Your Data Rights

The Services are not designated to users under the age of 18. If you are under 18, you should not use the Services nor provide any Personal Information to us. We do not knowingly collect the Personal Information of persons under 18 years of age.

In the event that we become aware that a user under the age of 18 has shared any information, we will discard such information. If you have any reason to believe that a minor has shared any information with us, please contact us at protection@piku.africa

We respect your privacy rights and therefore you may contact us at any time and request the following:

  • the Personal Information we hold about you;
  • to rectify your Personal Information if it becomes inaccurate or incomplete;
  • to have incomplete Personal Information completed. This may include providing a supplementary statement. Whether or not this is appropriate in any particular case depends on the purposes for which your information is being processed;
  • to erase your Personal Information if:
    • your Personal Information has been processed unlawfully by us; or
    • your Personal Information is no longer necessary for the purposes for which it was collected by us; or
    • You object to processing and there is no overriding legitimate interest for continuing to process your Personal Information.
  • to restrict our processing of your Personal Information if:
    • you contest the accuracy of the Personal Information held by us (for a period enabling us to verify the accuracy of the Personal Information);
    • our processing activities are unlawful; or
    • we no longer need your Personal Information but you would like us to retain it to ensure its continued availability to you in connection with any legal claims.

You undertake to update us if there are any changes or inaccuracies in your Personal Information.

Please note that objecting to our processing of your Personal Information will result in us being unable to continue to offer our Services to you which may lead to us closing your account. When requesting any of the above information from us, you have the right to ask that your Personal Information be provided to you in a generally understandable format.

Kindly note that the above rights are not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse your request. For example, we may refuse your request in instances where we need to process the Personal Information to exercise or defend legal claims. In addition, in certain instances, your Personal Information may have been destroyed, erased, or made anonymous in accordance with our record retention obligations and practices.

To exercise your rights, you are required to submit a request detailing what information you wish to enquire about, together with proof of identity to the Data Protection Officer at protection@piku.africa. We may then request further details in order to process your request.
